Terms of Service

Phoenix Digital LLC (“BlazeFiit,” “we,” “us,” or “our”) operates the BlazeFiit mobile application (iOS and Android) and the associated web platform at blazefiit.com (collectively, the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Service.

By creating an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

BlazeFiit is a white-label fitness coaching platform. The Service enables fitness coaches (“Coaches”) to create virtual gyms, design training programs, and manage their clients. Clients (“Members”) use the Service to track workouts, nutrition, body measurements, and goals, and to communicate with their Coaches through in-app messaging.

Key features of the Service include:

• Workout logging and exercise tracking
• Nutrition and meal logging
• Body measurement and progress photo tracking
• Goal setting and progress monitoring
• Gamification elements including XP, levels, badges, leaderboards, and challenges
• In-app messaging between Coaches and Members
• Optional integration with Apple HealthKit and Google Health Connect for health and fitness data

3.1 Coach Accounts

Coaches may register for an account directly through the Service. By creating a Coach account, you represent that you are at least 18 years of age and that the information you provide is accurate and complete.

3.2 Member Accounts (Invite-Only)

Access for Members is invite-only. You may only create a Member account if you have received an invitation from a Coach. Uninvited sign-ups may be removed without notice.

3.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@blazefiit.com if you suspect unauthorized use of your account.

The Service is currently offered free of charge during its beta period. We reserve the right to introduce paid plans, modify features, or change pricing at any time. We will provide reasonable notice before any pricing changes take effect.

During the beta period, the Service is provided on an “as-is” basis. Features may be added, modified, or removed without prior notice as we continue to develop and improve the platform.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Impersonate another person or misrepresent your affiliation with any person or entity
• Upload content that is defamatory, obscene, threatening, harassing, or that infringes on the rights of others
• Attempt to gain unauthorized access to other users’ accounts, data, or any part of the Service’s infrastructure
• Use automated tools, bots, or scripts to access or interact with the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service
• Distribute spam, unsolicited messages, or promotional content through the messaging features
• Reverse-engineer, decompile, or disassemble any part of the Service

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

6.1 Your Content

You may upload, submit, or transmit content through the Service, including progress photos, meal photos, workout logs, messages, and profile information (collectively, “User Content”). You retain ownership of your User Content.

6.2 License Grant

By submitting User Content, you grant Phoenix Digital LLC a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit that content solely as necessary to provide and operate the Service. This license ends when you delete your content or your account, except where retention is required by law.

6.3 Content Standards

You are solely responsible for your User Content. You represent that you own or have the necessary rights to submit it, and that it does not violate any third party’s rights or any applicable law.

Coaches who create gyms and manage Members through the Service acknowledge and agree that:

• They are solely responsible for the training programs, nutrition guidance, and advice they provide to their Members
• They will obtain any certifications, licenses, or insurance required by their jurisdiction to provide fitness coaching services
• They will not use the Service to provide medical advice or diagnosis
• They are responsible for ensuring their Members’ data is handled in accordance with applicable privacy laws

BlazeFiit is a platform that facilitates the coach-client relationship. We do not employ Coaches, and we are not responsible for the quality, safety, or legality of any coaching services provided through the platform.

8.1 Health Integrations

The Service offers optional integration with Apple HealthKit (iOS) and Google Health Connect (Android). If you choose to connect these services, we will access and display the health data categories you authorize (such as steps, sleep, heart rate, and workout data). You can revoke this access at any time through your device’s settings.

8.2 Not Medical Advice

The Service is intended for general fitness tracking and coaching purposes only. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have a pre-existing health condition.

8.3 Assumption of Risk

Physical exercise carries inherent risks. You acknowledge that you participate in workouts and fitness activities at your own risk. BlazeFiit is not liable for any injury, illness, or damage resulting from your use of the Service or any training program accessed through it.

The Service includes gamification elements such as experience points (XP), levels, badges, leaderboards, and challenges. These features are designed to enhance motivation and engagement. They carry no monetary value and cannot be exchanged, transferred, or redeemed for cash or any other consideration.

The Service, including its design, logos, text, graphics, software, and all other content created by Phoenix Digital LLC (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

You may stop using the Service and request account deletion at any time by contacting us at support@blazefiit.com.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, extended periods of inactivity, or discontinuation of the Service.

Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHOENIX DIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Phoenix Digital LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in Georgia.

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” at the top and notify users through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Phoenix Digital LLC regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
